Terms & Conditions

We look forward to providing you with excellent service! Please read these Terms and Conditions ("Terms", "Terms & Conditions", "T&Cs") before using this website or any website (the "Sites") operated by Validential Corp. ("us", "we", or "our") and before ordering and/or purchasing any academic evaluation or document translation products from us ("Product" or "Products"). These Terms apply to all visitors, users and others who wish to access or use our Sites or order our Products. Your access to and use of the Sites or Products is conditioned upon your acceptance of and compliance with these Terms. By accessing or using the Sites or ordering our Products you agree to be bound by these Terms. If you disagree with any part of the Terms, then you do not have permission to access the Sites or order our Products from us.

100% Acceptance Guarantee

We guarantee that your Immigration Course by Course evaluation will be an accepted assessment of your foreign studies for US immigration, continuing education or work purposes, and that your Standard Course by Course evaluation will be an accepted assessment of your foreign studies for continuing education or work purposes, or we will refund your evaluation fee/s in full.

If your Course by Course evaluation is not accepted for this purpose, simply advise us via email here and (if applicable) mail your original Course by Course evaluation document/s back within 90 days of order completion to 3334 East Coast Hwy #315, Corona del Mar, CA 92625. Your refund will be processed upon receipt of your request and/or returned Course by Course evaluation document/s.

Exclusions: While our evaluations are widely accepted for licensing purposes, our 100% Acceptance Guarantee does not apply to evaluations used for licensure, for institutions with prescribed lists (see Wrong Agency guarantee), for Canadian immigration or to General evaluations. If you require an evaluation for licensure, we recommend you contact the appropriate licensing board prior to ordering in order to confirm that our evaluation will be accepted by that licensing board. We do not refund expended mailing, scan, copy, rush or processing fees.

Next Day Guarantee

If your Draft evaluation document/s is not emailed to you the Next Day after your order is placed, your evaluation is free.

Next Day means the next calendar day (and not '24 hours') after the day on which your order was placed, but excludes national US public holidays and Scheduled Vacations & Maintenance (as defined herein).

Conditions: Evaluation orders are counted as placed when full payment is received for the invoice, or for Self-Served Orders, when the correct order was approved by our staff. For orders that first require translation, the evaluation order is considered placed when the corresponding translation has been approved by you using the provided links. For graduate-level Course by Course for Immigration evaluations we also require undergraduate documents, so the order is considered as placed once we have received those additional documents.

Your Order History is the official record of delivery of your Draft document/s via email – we are not responsible for delays in receipt due to emails being routed to your spam/junk mail folder, emails being stopped altogether by your email service provider, delays due to non-responsiveness to our emails, or for incorrect email addresses provided by you.

Exclusions: Self-Served orders that were not completed correctly; orders with incomplete or unclear source documents or with client requirements that are not feasible (in our evaluators' judgment); orders impacted by Force Majeure; orders that include document authentication; and orders with invoices that were paid more than 90 days after issuance are not eligible for this Next Day Guarantee. We do not refund expended mailing, scan, copy, rush or processing fees.

Satisfaction Guarantee

If you're not satisfied with your Course by Course evaluation and we can't fix it based on the documents you've provided, you can cancel prior to Mailing or Electronic Delivery for a full refund of the evaluation fee.

Exclusions: We do not refund for change-of-mind, expended mailing, scan, copy, rush or processing fees.

Cancellations

Orders may be cancelled for a full refund by contacting support@validential.com (only) prior to your Order History showing "Order started". Amounts refunded (if any) after this time are subject to these Terms.

Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to access our Sites or order Products from us after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new Terms, you are no longer authorized to access our Sites or order Products from us.

Document Authentication

We provide authentication of educational documents upon request. The process of document authentication lengthens the time to complete our evaluation corresponding to the length of time it takes your prior educational institution to comply with the authentication request. This additional time may range from several days to several months (and in some cases, some institutions may be non-responsive).

Document Retention Policy

Electronic documents provided to us for translation and/or evaluation are automatically deleted from our system 90 days after your order is completed. Please note that documents mailed directly from your institution to us ('hard copies') are typically marked as confidential/not for distribution; we honor such requests and cannot provide those documents to you, although we will mail them to other institutions upon request. Hard copies will be scanned to facilitate your order completion and the scans are deleted 90 days after order completion; hard copies are destroyed six months after order completion.

While your completed evaluations and/or translation documents do not expire, we do not guarantee that copies of your completed orders will be retained in our system more than three years after order completion. We strongly recommend that you make and retain your own copies of your evaluated and/or translated documents for your future use.

Draft/s

We email your draft translation and/or evaluation document/s for your review and approval prior to mailing ("Draft" or "Draft/s"). We require you to follow the instructions and use the links provided in order to process your order timely. We are not responsible for delays due to emails being routed to your spam/junk mail folder, emails being stopped altogether by your email service provider, delays due to non-responsiveness to our emails, or incorrect email addresses provided by you.

Edit Requests

Edits are easily requested using the CHANGES link emailed with your draft document/s. CHANGES links are document-specific, so any edit/s requested apply only to the document/s attached to the email containing that CHANGES link (edits will not apply to any other document/s in your order unless you also use the appropriate CHANGES link/s associated with those other document/s in your order). We do not accept edit requests via email or over the phone.

Electronic Delivery 

If you don't respond to your Draft/s using the provided links within three calendar days of them being emailed to you (according to our system logs), you hereby accept the Draft/s as-is, and consent to the electronic delivery of your certified final document/s via email.

If your order includes mailing and you enter only an email address or an incomplete mailing address when accepting your Draft document/s, you consent to the emailed delivery of your final certified scanned document/s to complete your order. We will gladly mail your final document/s once you provide us with your complete mailing address.

Estimated Order Completion Times

Standard times to email your initial Draft/s for your review and approval are typically one calendar day for translation orders and Next Day for evaluation orders (pursuant to the conditions of the Next Day Guarantee).

Non-English documents must be translated first, so order delivery times are additive based on your order. For example, if you ordered an evaluation and your order also includes translation, then your evaluation order is due the next day after your translation has been completed and accepted using the links provided.

Exclusions

Some jurisdictions do not allow excluding or limiting implied warranties or limiting liability for incidental or consequential damages, and some jurisdictions have special statutory consumer protection provisions which may supersede the foregoing disclaimers and limitations. As a result, these disclaimers and/or limitations may not apply to you if prohibited by law.

Our representatives, agents or employees do not have the authority to make any warranty, representation, promise or agreement, whether in writing or orally, on behalf of us except as stated within these Terms.

Force Majeure

We are not responsible for order delays due to causes beyond our reasonable control, including (but not limited to): acts of God, war, hosting failure, denial of service attacks, malware, failure of third-party websites and/or services, equipment or software failure, internet outages, system issues, strikes, acts of terrorism, riot, epidemics, unusually severe weather conditions, floods, fires, power outages, hurricanes or other material contingencies, the non-occurrence of which was a basic assumption upon which our Products are offered and/or our Next Day guarantee is made.

Foreign Language/Non-English Documents

All documents must be in English for evaluation purposes. If they're not already in English, we provide certified translation services, or can typically accept certified translations from other translation agencies.

Fraudulent or Doctored Documents; Fake Schools or Diploma Mills

Based on our industry expertise, if we reasonably believe that you provided us with any document/s for translation and/or evaluation that are fraudulent or doctored, or documents that were issued by a fake school or diploma mill, then the order will be cancelled.

General Evaluations

While General evaluations may be widely accepted, we complete General evaluations upon request only and we do not guarantee General evaluations for any purpose. We recommend you check with any intended recipient prior to ordering a General evaluation to ensure that this evaluation type is sufficient for their needs. We do not consolidate different courses of studies for General evaluations (you will instead require a Course by Course evaluation of each course of studies to be consolidated). General evaluation fees are strictly non-refundable once your Order History shows "Order started".

Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Site and Products, and supersede and replace any prior agreements we might have had between us regarding the Site and Products.

High School Evaluations

High school Course by Course evaluations include the two most senior years of studies, and we do not include credit calculations unless requested in advance.

Indemnification

You agree to defend, indemnify and hold harmless Validential Corp. and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorneys’ fees), resulting from or arising out of a) your use and access of the Sites, b) your use and/or purchase of our Products, or c) a breach of these Terms.

Intellectual Property

The Sites and original content, features and functionality are and will remain our exclusive property. The Sites are protected by copyright, trademark, and other laws of both the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

Late Changes/Correction After Mailing

We email your Draft/s for the express purpose of your careful review of your document/s for approval to finalize, so please check your Draft/s carefully prior to approving them. If you notice a typographical error after your order is finalized, we will provide a one-time correction per document at no charge (delivered via email only). Other edit requests received after the order has been finalized will be charged at the rate of $15 per edited document. Re-mailng of orders (regardless of reason) will be charged at the then-applicable mailing rate.

Limitation of Liability

In no event shall we, nor our directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use of the Site or our Products; (ii) any conduct or content of any third-party on the Site; (iii) any content obtained from the Site or our Products; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

Notwithstanding any provision to the contrary, the total liability of Validential Corp. and its employees and consultants, for all losses, damages, costs, and expenses, including attorneys’ fees, shall not exceed the aggregate amount paid to us for Products under this Agreement, regardless of the legal theory under which such liability is imposed.

Links to Other Web Sites

Our Sites may contain links to third party web sites or services that are not owned or controlled by us. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party web sites or services. We do not warrant the offerings of any of these entities/individuals or their websites. You acknowledge and agree that we shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by, or in connection, with the use of or reliance on any such content, goods or services available on or through any such third-party web sites or services. We strongly advise you to read the terms and conditions and privacy policies of any third-party web sites or services that you visit.

Mailing

Orders that include mailing include one copy of each document in your order mailed via standard US mail - first class; no tracking number. If requested, we can add additional copies, mail to additional addresses, and add tracking (fees apply).

You submit your preferred mailing address using the ADDRESS link in your Order Summary email, or by using the ACCEPT link when accepting your final Draft/s. The exact address and format submitted is the exact address and format your document/s are mailed to.

WE ARE NOT RESPONSIBLE FOR INCORRECT, INCOMPLETE, OR INCORRECTLY FORMATTED ADDRESS INFORMATION SUBMITTED BY YOU.

We are not responsible for any variance in carrier shipping times, carrier website issues, carrier non-delivery, returned mail, or documents lost or damaged in transit.

We do not refund for document/s that are lost in transit. If your documents are lost in transit, please advise us within 60 days of the order completion date and as long as the address originally entered conformed with this formatting, we will send one-time courtesy replacement document/s to the same address via first class standard mail (no tracking). Mailing to any variation or correction of the address previously entered will incur the then-applicable remailing fee. Remailing to any address more than 60 days after order completion date will be subject to the then-applicable mailing fee/s.

If your documents are damaged in transit, please send us a picture via email here, and we'll send one-time courtesy replacement document/s to the same address at no charge via first class standard mail (no tracking).

If you enter more than one mailing address but have not paid the required fees, we will mail your documents to the first complete address entered. If you provide an incomplete or no physical mailing address, you will receive Electronic Delivery of your certified final document/s if your order includes a scan, or an emailed request for an address if your order does not include a scan.

If you ordered 2 Day Priority Mail and entered a mailing address outside the US, we will send your order via standard mail and refund the 2 Day Priority Mail fee.

We do not use prepaid shipping labels provided by third parties, nor do we use third-party shipping accounts. We do not include phone numbers on addresses.

Shipping times represent the delivery time advertised by your chosen carrier and are not guaranteed by our agency. Standard mailing takes an estimated one week within the US, two weeks to Canada, and 3+ weeks for other countries. Standard mailing within the US may take longer due to USPS delivery times or seasonal mailing delays. 2 Day 'Priority Mail' is available within the US only and is an advertised USPS shipping service; actual shipping times are between 1 and 3 business days depending on your location. FedEx shipping is for delivery Monday-Friday and is not available in all areas. If FedEx overnight shipping is not available, we request 'first available date'; Saturday delivery is by request only; additional fees apply. International FedEx mailing fees are subject to final review when processing your order for mailing. If FedEx shipping costs to your location exceed the shipping fees we charged you, your order will be subject to a shipping surcharge. We will contact you regarding the revised shipping fees and you will be able to modify or cancel your shipping order at that time.

The cutoff time for mailing is 3.00pm PST Monday through Friday. Orders processed for mailing after this time are dispatched to your selected carrier the following business day. Mailing may be delayed during Scheduled Vacations & Maintenance.

Documents that are remailed retain the original order completion date; if you require the date to be updated, the then-applicable edit fee will apply per document modified.

Non-Refundable Products

Your order is custom-made based on your unique documents. Except as covered under our guarantees, respective fees for evaluations and/or translations are strictly non-refundable once your Order History shows "Order started".

If you provided us with the wrong documents for translation and/or evaluation, the respective fee is non-refundable once your Order History shows "Order started".

We do not refund for 'change of mind' once your Order History shows "Order started". We do not refund expended mailing, scan, copy, processing or rush fees.

Non-Responsiveness

To ensure timely completion of your order, if you don't use the links in our emails to respond to your Draft/s within three days of them being emailed to you (according to our system logs), you thereby accept the Draft/s as-is, and we will proceed with/finalize your order accordingly.

Notarization

After April 23, 2021, documents will remain certified in all respects, but will no longer be notarized.

Order Delivery/Completion

For orders that include scans, orders are considered delivered once the scans are emailed to you, as identified in your Order History. For mailed orders, orders are considered delivered when dispatched to your chosen mail carrier, as identified in your Order History.

Order History

We operate within the United States' Pacific Standard Time ("PST") zone. You hereby agree that our system logs reflect the accurate and final history of events related to your order (your "Order History"), including (but not limited to) the times and dates of: order starts, emailed Draft/s and/or scanned documents, mailing, correction requests, approval of Draft/s, sending of SMS notifications, and provision of your mailing address (if applicable). You may view your Order History at any time by clicking on the 'ORDER STATUS' link in your Order Summary email (sent after order activation; if you didn't receive that email, please notify us via email here and we'll re-email it to you).

Evaluations with due dates that fall on a U.S. national public holiday are due the following day.

Orders Not All-or-None

Guarantees apply to each evaluation we prepare for you. You may cancel any or all of your order at any time in accordance with these Terms, however, a refund or cancelation of one part of your order does not entitle you to a refund or cancelation of any other part of your order unless also refunded or canceled in accordance with these Terms.

Order Status

Order Status may be viewed at any time by clicking on the ‘ORDER STATUS’ link in your Order Summary email (sent after order activation; if you didn’t receive that email, please notify us via email here and we’ll re-email it to you). Please note that we do not provide order status over the phone or via email.

Orders That Require Translation

If your order requires translation and we identify that you did not pay sufficient evaluation fee/s for all documents submitted, we'll evaluate the most recent course of studies first. We will gladly complete your corrected order upon receipt of the correct payment.

Preliminary Review

We're pleased to provide a preliminary review of your documents for the purposes of assessing completeness for, and accuracy of, your quotation. However, all orders are subject to final review by an evaluator during the evaluation process. If the order quoted was incorrect for your order and you do not accept a revised quotation, or if you're unable to provide us with additional documents that may be requested by an evaluator, you may cancel your order and we will refund you (excluding processing fees).

Processing Fee

All orders are subject to a 2% card processing fee. This fee is strictly non-refundable.

Product Fulfillment 

If you wish to order any Products made available via our Sites, you may be asked to supply certain information relevant to that order, including, without limitation, your credit card number, your billing address, the documents you need our Products applied to and your shipping information. You represent and warrant that: (i) you have the legal right to use any credit card/s or other payment method/s in connection with any order; and that (ii) the information and documentation you supply to us is true, correct and complete in all respects. We may employ the use of third-party services for the purpose of facilitating payment and the completion of Products. By submitting your information, you grant us the right to provide the information to these third-parties subject to our Privacy Policy. We reserve the right to refuse or cancel your order at any time and for any reason, including but not limited to: service availability, errors in the description or price of the Products, errors in your order, illegible documentation, suspected payment or document fraud, or suspected unauthorized or illegal transactions.

Quotes

Quotes that conform to the prices listed on our site are honored for 7 calendar days after quotation. We are pleased to provide an initial review and quote of your documents for evaluation, however, our review does not confirm any particular outcome nor accuracy of the quote for all tendered documents. All orders are subject to a final review during the evaluation process of your tendered documents in order to ensure completeness as well as the accuracy of your quote. If you do not accept any revised quotation as a result of the final evaluator review, we will be pleased to provide a full refund of the evaluation fee (prior to mailing) of your order.

Refunds

We have the most robust guarantees and refund policy in the industry, so if you have any issues, we'll gladly refund you according to these Terms. Refunds are processed after the original evaluation document/s are mailed back to us, and any refund (in whole or in part) is reduced by the total discount/s applied when your order was placed. Refunds are processed to the original payment account only, and although it usually takes less, kindly allow up to 10 business days for your credit to post back to your card account.

We consider chargebacks to be academic fraud, so please contact us first if you have any order issues - we're happy to assist. If you chargeback any payment to us we will decertify all documents issued by us for all orders placed with our agency, flag all your orders as fraudulent, contact all third-parties to whom any document/s were submitted to advise them of academic fraud, file a report with AgencyShare (an international service that shares information about academic fraud with other academic evaluation agencies, schools, colleges, universities, employers, government agencies and USCIS), and dispute the chargeback. If you wish to have your documents recertified after a chargeback, a $50 chargeback fee will apply per document.

Exclusions: We do not refund expended mailing, scan, copy, rush or processing fees. We do not refund for document/s that are lost or delayed in the mail (see Mailing above).

Same Day Rush Orders

Same Day Rush fees are separate from evaluation and translation fees, and apply only to the evaluation portion/s of your order (please note that we do not offer same day rush translations). Draft evaluation/s for Same Day Rush orders will be emailed within 12 hours of either 1) for invoiced orders, your invoice payment, or 2) for self-served orders, after your order was reviewed and approved by us, or 3) for orders that first require translation, after the corresponding translation/s are approved by you using the provided links. If your Same Day Rush evaluation/s are not delivered within 12 hours of the applicable condition, your rush fees will be refunded.

Scanned PDF Document/s

Scans are emailed promptly after order approval. Due to time zone differences, dates on your scanned document/s may vary slightly from dates on your physical document/s. Signatures on your scanned document/s may also vary from signatures on your physical document/s.

For orders that included scans, we retain your PDF document/s for 12 months after order completion and will gladly forward your scans via email up to three times after order completion at no charge; forwarding requests in excess of this will be charged at the rate of $10 per email. For orders that originally included scans, requests for scans more than 12 months after order completion will be charged at the rate of $10/email. For orders that did not include scans, the order will first be subject to the then-current scan fee per document.

Scheduled Vacations & Maintenance

US Thanksgiving: from Wednesday before Thanksgiving to Friday after Thanksgiving, inclusive.

Christmas: from December 23 through to January 1st, inclusive.

While we do receive and process orders timely during Scheduled Vacations & Maintenance, our Next Day Guarantee does not apply during these periods; scans and mailing may also be delayed during these periods.

Self-Served Orders

If you self-served an order incorrectly and the amount paid is less than the amount still due, your order will be canceled and refunded (less processing fees).

If you uploaded more than one course of studies, we will evaluate the specified course of studies or if none are specified, then the most recent course of complete studies uploaded.

We'll attempt to contact you if your self-served order has insufficient payment or documentation issues, but if you don't responsd and/or pay the correct fees within 24 hours after our communication, we'll cancel and refund your order (less processing fees).

Signatures

Signatures on scanned documents may vary from signatures on the same mailed documents. Signatures and stamps are electronic and not 'wet'.

Social Security Numbers; Date of Birth; Course Codes; Subject Substitution

We do not include social security numbers or date of birth in our evaluations. Unless specified in advance, course codes are not included with subject names (to submit any required course codes to the intended recipient of the evaluation/s, simply provide them with your original educational documents). We do not substitute subjects with the equivalent or similar US or Canadian subjects.

SMS Notification Consent

Provision of your cell phone number represents your consent to receive SMS notifications from us related to your order status (only). We do not sell your information to third-parties. You can cancel future messages at any time by replying to our text with ‘STOP’. Message and data rates may apply.

Source Document Data Integrity

We preserve name and sex data between source and evaluation document/s. You can address subsequent changes to this data by providing proof-of-change documents (e.g., marriage, divorce, name change etc. certificate) directly to the intended recipient of the evaluation/s.

Stated Purpose or Recipient

All orders are subject to these Terms, regardless of any stated purpose and/or intended recipient you may have provided during the order process.

Support Hours

Our Support Hours are Friday to Monday 8am-4pm, and Tuesday to Thursday 5am-9pm, exclusive of Scheduled Vacations & Maintenance.

Surcharges

Surcharges apply for translations above 250 words/page, or for additional services requested by clients. Surcharges will be identified on your invoice.

Translations

Translation fees are strictly non-refundable once your Order History shows "Order started". We do not convert currencies or dates, or translate the names of people, institutions or addresses. We translate the text and layout of the original document, but do not guarantee identical fonts or backround imagery. Mailing of translations is included at no charge with evaluation orders. For documents with more than one language, our quote is to translate one language only (additional fees will apply for each additional language translated). Source documents are not appended to translations. Source documents are not mailed with your order, however, we can mail the source documents if you request this prior to mailing.

US Equivalency 

All evaluations are prepared to US equivalency unless you have specified (prior to order completion) that the evaluation is needed for Canadian equivalency.

Written Feedback

We value your feedback. By providing us with written correspondence, you consent to our use of that content or excerpts thereof - along with the use of your first name, your last initial and the date of your correspondence - on our website and/or in our advertising materials. You may revoke this right at any time by advising us in writing here. Spelling or grammatical errors may be corrected prior to usage.

Wrong Agency Guarantee

Our evaluations are accepted nationwide, but no agency is accepted everywhere so we recommend you confirm acceptance with the intended recipient prior to ordering from any agency. If the intended recipient of the evaluation required you to order from a different agency or list of agencies, but you ordered from our agency instead, we will gladly refund your evaluation fees in full if you cancel before your order history shows "Order started". We will refund the Course by Course evaluation fee/s less a $45 labor fee per evaluation after your order history shows "Order started".

Simply advise us via email here, and (if applicable) mail your Course by Course evaluation document/s back within 90 days of order completion to 3334 East Coast Hwy #315, Corona del Mar, CA 92625. Your refund will be processed upon receipt of your request and/or returned Course by Course evaluation document/s.

Exclusions: If you advise us prior to ordering that you are required to order from a different agency or list of agencies, but you ordered from our agency instead, this Wrong Agency guarantee does not apply. Please note that we do not provide refunds for General evaluations, processing fees, translations that have already started, or expended mailing, scan, copy or rush fees.

Disclaimer

Except for our guarantees, our Sites and Products are provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance. Your use of our Sites or Products is at your sole risk. The Sites or Products are provided on an "as is" and "as available" basis.
